1. Acceptance of Terms
By accessing or using Mixroom ("Platform"), operated by Mixroom Inc. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. We reserve the right to update these terms at any time. Continued use after changes constitutes acceptance.
2. Platform Description
Mixroom is a two-sided marketplace connecting recording studios and mixing/mastering engineers ("Service Providers") with artists, producers, and music creators ("Clients"). We facilitate bookings, payments, and communication but do not provide recording, mixing, or mastering services ourselves.
3. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 18 years old to use the Platform. Studio and engineer accounts require approval before they can accept bookings.
4. Bookings and Payments
For Clients: When you book a studio session, you agree to pay the listed rate plus a 10% service fee. For instant-booking studios, your card is charged immediately. For request-to-book studios, your payment method is saved and charged only if the studio approves your request. If payment fails after approval, you have 4 hours to update your payment method before the booking is automatically cancelled.
For Service Providers: You receive 90% of the booking total. Payouts are processed through Stripe Connect. You must complete Stripe onboarding to receive payments. Instant payouts are available for a 1.5% fee (minimum $1).
Flexible Sessions: For flexible session bookings, a $200 hold may be placed on the client's card to cover potential add-on charges. This hold is only captured if the client signs an additional charges form. Uncaptured holds are released when the session is marked complete.
5. Cancellation Policy
Sessions under 24 hours: Free cancellation up to 48 hours before the session.
Sessions 1-2 days: Free cancellation up to 4 days before the session.
Sessions over 2 days: Free cancellation up to 1 week before the session.
Cancellations within the policy window receive a full refund. Studio-initiated cancellations always receive a full refund regardless of timing. Refunds are processed within 5-10 business days.
6. Service Provider Obligations
Studios and engineers agree to: provide accurate listing information; honor confirmed bookings; maintain a safe and professional environment; deliver files within the agreed turnaround time; respond to client messages in a timely manner. Failure to meet these obligations may result in account suspension.
7. Client Obligations
Clients agree to: arrive on time for studio sessions; treat studio equipment and spaces with respect; provide accurate project details for mixing/mastering requests; review and respond to deliveries within a reasonable timeframe; not dispute legitimate charges.
8. Prohibited Conduct
You may not: use the Platform for any illegal activity; misrepresent your identity or qualifications; manipulate reviews or ratings; circumvent the Platform's payment system; harass or threaten other users; upload malicious content; attempt to access other users' accounts; scrape or crawl Platform data.
9. Reviews and Ratings
Users may leave reviews after completed bookings. Reviews must be honest and based on genuine experiences. We reserve the right to remove reviews that violate these terms, contain hate speech, are fraudulent, or are unrelated to the booking experience.
10. Intellectual Property
All recordings, mixes, and masters created during sessions remain the intellectual property of the respective rights holders. Mixroom does not claim ownership of any creative works produced through the Platform. The Mixroom name, logo, and platform design are our intellectual property.
11. AI Features
Mixroom uses artificial intelligence to enhance the user experience, including but not limited to: registration assistance, session prep analysis, pricing suggestions, mix feedback translation, review summaries, and support chat. AI-generated content is provided as suggestions only and should not be considered professional advice. We do not guarantee the accuracy of AI outputs.
12. Dispute Resolution
Payment disputes should first be raised through the Platform. We will review disputes and may mediate between parties. For Stripe payment disputes (chargebacks), we will submit relevant evidence including booking details, signatures, and communication records. Filing fraudulent disputes may result in account termination.
13. Limitation of Liability
Mixroom is a marketplace platform and is not liable for: the quality of services provided by studios or engineers; equipment damage or personal injury during sessions; disputes between clients and service providers; loss of data or creative works; service interruptions. Our total liability is limited to the fees paid to us in the 12 months preceding the claim.
14. Termination
We may suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any other reason at our discretion. You may delete your account at any time by contacting support@mixroom.app. Upon termination, pending bookings will be handled according to the cancellation policy.
